Tony practices insurance law with an emphasis
on property and liability coverage disputes, the defence
of complex multi-party property damage and products liability
claims, and the defence of professional malpractice claims.
He provides advice to insurers in the areas of policy wordings,
claims handling and underwriting procedures. Tony is an
Adjunct Professor at the University of British Columbia’s
Faculty of Law, where he teaches Property/Casualty Insurance
Law. He also lectures regularly at continuing education
courses in the areas of professional liability, commercial
property insurance and the law of bad faith.
Tony’s recent work includes:
- Defence of an engine remanufacturer,
in a multi-million dollar fire at a natural gas field compressor
station in northeastern B.C.;
- Defence of a parts manufacturer, in a series of related
fatality claims arising out of a collision in Vancouver
harbour;
- Defence of a drug manufacturer in a case involving alleged
brain damage resulting from a physician’s off-label
prescription;
- Subrogation against a railroad for fire loss of the entire
inventory of logs, and related property damage totalling
more than $20 Million, at a strandboard plant;
- Coverage advice to a Boiler and Machinery insurer as to
whether successive losses at a pulp mill constituted separate
occurrences;
- Coverage defences under several property policies for
losses arising out of corrosion and fatigue cracking at
pulp mills and chemical plants;
- Coverage advice to several Canadian liability insurers
in respect of advertising liability claims made against
their Insureds in the United States;
- Coverage defences in several construction losses arising
out of faulty workmanship or design errors
