Court Hearing Fees are Constitutional Vilardell v. Dunham

The BC Court of Appeal has considered whether the practice of charging hearing fees for trials that are more than three days in length is unconstitutional as it hindered Access to Justice for impecunious litigants. Julie K. Lamb and Stephanie L. Hamilton explain how the appellate court upheld the constitutionality of the practice but has opened the door to a number of exemptions from those fees based on financial need.
