Julie K. Lamb obtains dismissal of claim in coverage dispute

Skipper Properties Ltd. v. Zurich Insurance Company Ltd concerned a lawsuit in which the plaintiff sought to have its own property damage covered under a wrap up liability policy under which it was an additional named insured. Mr. Justice Johnston interpreted the terms of the insurance policy and ruled that the plaintiff no direct right of action against the insurer for its claimed losses instead its claims were against those whose activities caused the losses. As such the court dismissed the lawsuit with costs payable to the insurer.
