By way of update to our case note posted November 8, 2019 (here); in a judgment dated January 9, 2020, the Supreme Court of Canada has dismissed, with costs, the Defendant Appellant’s application for leave to appeal (https://scc-csc.lexum.com/scc-csc/scc-l-csc-a/en/item/18091/index.do). It seems that, for now, the questions posed in our case note remain unanswered.
