Briefing Note: Freedom of Information and Protection of Privacy Act

On May 28, 2026 the BC government amended the Freedom of Information and Protection of Privacy Act, which has changed the scope of freedom of information (“FOI”) requests both in time, and in requestable materials. One such change is to s3(5)(e), which appears to prevent parties from circumventing limits on document disclosures by making FOI requests. Despite changes, on our reading, this amendment has not adversely altered the relationship between litigation and FOI requests.
