Briefing Note: Bucci v UBC, 2026 BCHRT 19

As an increasing number of complaints are filed with the BC Human Rights Tribunal, Bucci v The University of British Columbia and others, 2026 BCHRT 19 reminds individuals and corporations of the value of making a reasonable settlement offer early in a human rights complaint. Not only can it provide the respondents with an opportunity to make an early exit from the dispute, but it can be used to ground an application to dismiss a complaint under s.27(1)(d)(ii) of the Human Rights Code, should the offer be refused. In this briefing note, Andrew Weir and Adam Howden-Duke discuss the Bucci decision and the principles underlying the often-overlooked value of reasonable settlement offers.
