Briefing Note: Ahluwalia v Ahluwalia, 2026 SCC 16

The Supreme Court of Canada has recognized a novel tort of intimate partner violence which allows compensation for intentional coercive control that “directly interferes with the plaintiff’s legal interests in dignity, autonomy, and equality within an intimate partnership.” This Briefing Note analyzes the history of the relevant litigation, the elements of the new tort, and considers its role in the evolution of Canadian tort law.
