Unlike may other aspects of it’s jurisdiction, the Civil Resolution Tribunals’ jurisdiction to resolve strata disputes does not have a monetary limit. This, coupled with the need to obtain leave of the Tribunal to have counsel act, can raise unique issues in the defence of liability claims against stratas, Happily in Raye v. The Owners, Strata Plan LMS 2969, leave was granted and the claim was dismissed given the expert evidence obtained on the strata’s behalf.
