In Owners, Strata Plan EPS 3699 v. Siemens, 2025 BCSC 227, the BC Supreme Court reviewed the Civil Resolution Tribunal’s (“CRT”) decision regarding a dispute over an owner’s parking space. Siemens demonstrates the considerations that must be made in designating common property or making changes affecting limited common property, as well as the fact that the CRT cannot order a Strata to act ultra vires the Strata Property Act, SBC 1998 c.43 (“SPA”).
